Wage and Hour Division (WHD)

Authority

Through Public Law 5-143, the Wage and Hour Division is charged with the responsibility to administer and enforce the Fair Labor Standards Act, promulgated under Title 22, Guam Code Annotated, Chapter 3, and Child Labor Laws under Title 19, Guam Code Annotated, Chapter 11, to protect workers against unpaid hours worked whether they are alien workers, U.S. citizens, persons with disability, trainees or minors.

Additionally, under Public Law 26-111, Section 5803, the Wage and Hour Division is charged with the responsibility to monitor compliance with these provisions and shall promulgate rules and regulations, pursuant to the Administrative Adjudication Law to ensure the equitable investigation of violations and the maintenance of due process, as well as the assessment of monetary penalties.
